What you’re purchasing
Your subscription entitles you, during the period of your subscription, to install and use Xenia (or the Xenia web interface), updates to Xenia, and the electronic and online documentation for Xenia (“Documentation”) subject to these Terms of Service, the terms of the end user licence agreement for Xenia (“End User Licence Agreement”) and our Privacy Policy.
However, Canimaan Software Ltd does not sell Xenia, the Documentation, or Web Interface to you; we remain the owners of Xenia, the Documentation, and Web Interface at all times.
When you complete your order, you’ll receive your subscription and registration details via email (the digital content delivery).
Who you’re purchasing from
The purchase and fulfilment of your subscription for Xenia are made through FastSpring, our reseller based in California, USA. FastSpring’s address is 8 E. Figueroa Street, Santa Barbara, CA 93101 USA and you can check out their W9 form if necessary.
These Terms of Service apply to your subscription in addition to Fastspring’s Terms of Sale.
Subscription period and renewal details
Your subscription will last for the period you choose at the time of ordering (your “Subscription Period”).
Unless you cancel your subscription before the end of your Subscription Period, your subscription will automatically renew at the end of your Subscription Period.
If your Subscription Period is 12 months or longer, a reminder email will be sent 10 days prior to your renewal date to the email address you provided when purchasing your subscription..
If you cancel your subscription, your subscription will expire at the end of your Subscription Period and Xenia will cease to function on that date.
If your renewal payment fails for any reason, your subscription will expire on that date and Xenia and your login for the Web Interface will cease to function. You will then have a 10 day grace period in which to update your payment details and try again. After the grace period, you would need to start a whole new order, and may lose access to any special offers which may have been available to you previously.
Scope of the subscription
A subscription for a Business Licence allows you, during your Subscription Period, to install and use ClamXAV for your internal business purposes, within a single organisation, on a single computer or, if applicable, on such greater number of computers specified in your order with us or our Reseller and listed in your registration details.
Updates
We may make Xenia or Web Interface Updates available during your Subscription Period.
You acknowledge the importance of downloading and installing these Xenia Updates, as well as any updates to ClamXAV, to maintain the effectiveness of ClamXAV and Xenia. You understand and agree, however, that no security product can prove 100% effective.
Support
We provide support to users with a current subscription. We also provide support documentation in the support section of our website.
Returns/refunds policy
We offer a fully functioning trial version of Xenia and the Web Interface which you can use to evaluate its functionality and see if it suits your needs before deciding whether to purchase a subscription.
As such, all requests for refunds of subscription payments will be evaluated by us on a case-by-case basis in our absolute discretion and, if granted, will be subject to a minimum processing fee of 15% of the subscription cost. To request a refund, please contact our sales team within 14 days of the date when your subscription was purchased or last renewed.
Payments by cheque, money order or bank/wire transfer are non-refundable.
Extra conditions
You consent to receive your sales invoice for your subscription electronically and this will be delivered to you via email with a link to where you can view or print your invoice online.
We reserve the right to make changes to our website, policies, End User Licence Agreement and these Terms of Service at any time.
Each of the terms of these Terms of Service operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining terms will remain in full force and effect.
By purchasing a subscription for a Business Licence, these Terms of Service, their subject matter and formation (and any non-contractual disputes or claims) are governed by Scots law. You and we both irrevocably submit to the exclusive jurisdiction of the Scottish courts in respect of this Licence and any disputes or claims under it or in respect of it.
The terms of the End User Licence Agreement are incorporated into, and form part, of these Terms of Service.
