What you’re purchasing
Your subscription entitles you, during the period of your subscription, to install and use ClamXAV, updates to ClamXAV, malware database updates (“Database Updates”) and the electronic and online documentation for ClamXAV (“Documentation”) subject to these Terms of Service, the terms of the end user licence agreement for ClamXAV (“End User Licence Agreement”) and our Privacy Policy.
However, Canimaan Software Ltd does not sell ClamXAV, the Documentation, or Database Updates to you; we remain the owners of ClamXAV, the Documentation, and Database Updates at all times.
When you complete your order, you’ll receive your subscription and registration details via email (the digital content delivery).
Who you’re purchasing from
The purchase and fulfilment of your subscription for ClamXAV are made through FastSpring, our reseller based in California, USA. FastSpring’s address is 8 E. Figueroa Street, Santa Barbara, CA 93101 USA and you can check out their W9 form if necessary.
These Terms of Service apply to your subscription in addition to Fastspring’s Terms of Sale.
Subscription period and renewal details
Your subscription will last for the period you choose at the time of ordering (your “Subscription Period”).
Unless you cancel your subscription before the end of your Subscription Period, your subscription will automatically renew at the end of your Subscription Period.
If your Subscription Period is 12 months or longer, a reminder email will be sent 10 days prior to your renewal date to the email address you provided when purchasing your subscription. No reminders will be sent for monthly subscriptions.
If you cancel your subscription, your subscription will expire at the end of your Subscription Period and ClamXAV will cease to function on that date.
If your renewal payment fails for any reason, your subscription will expire on that date and ClamXAV will cease to function. You will then have a 10 day grace period in which to update your payment details and try again. After the grace period, you would need to start a whole new order, losing access to any special offers which may have been available to you previously.
Scope of the subscription
A subscription for a Home Licence (including where your subscription is purchased with a student discount or family plan) allows you, during your Subscription Period, to install and use ClamXAV for your domestic and personal use (but not for business purposes) on the following number of computers:
- if your subscription was purchased with a student discount, on 1 (one) computer;
- if your subscription was purchased with a family plan, on up to 9 (nine) computers owned or leased by you or members of your family living together at the same home address; or
- in any other case, on up to 3 (three) computers that you own or lease personally. Students are offered a discount on subscriptions for Home Licences subject to eligibility and to verification of student status.
A subscription for a Business Licence (including Business Licences purchased with an educational discount) allows you, during your Subscription Period, to install and use ClamXAV for your internal business purposes, within a single organisation, on a single computer or, if applicable, on such greater number of computers specified in your order with us or our Reseller and listed in your registration details.
Database Updates
We will make Database Updates available during your Subscription Period.
You acknowledge the importance of downloading and installing Database Updates, as well as any updates to ClamXAV, to maintain the effectiveness of ClamXAV. You understand and agree, however, that no security product can prove 100% effective.
Support
We provide support to users with a current subscription. We also provide support documentation in the support section of our website.
Returns/refunds policy
We offer a fully functioning 30-day free trial version of ClamXAV which you can use to evaluate its functionality and see if it suits your needs before deciding whether to purchase a subscription.
As such, all requests for refunds of subscription payments will be evaluated by us on a case-by-case basis in our absolute discretion and, if granted, will be subject to a minimum processing fee of 15% of the subscription cost. To request a refund, please contact our sales team within 14 days of the date when your subscription was purchased or last renewed.
Payments by cheque, money order or bank/wire transfer are non-refundable.
Extra conditions
You consent to receive your sales invoice for your subscription electronically and this will be delivered to you via email with a link to where you can view or print your invoice online.
We reserve the right to make changes to our website, policies, End User Licence Agreement and these Terms of Service at any time.
Each of the terms of these Terms of Service operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining terms will remain in full force and effect.
If you purchase a subscription for a Home Licence (including Home Licences purchased with a student discount or family plan) these Terms of Service, their subject matter and formation, are governed by Scots law. You and we both agree that the courts of Scotland will have non-exclusive jurisdiction.
If you purchase a Business Licence (including Business Licences purchased with an educational discount) these Terms of Service, their subject matter and formation (and any non-contractual disputes or claims) are governed by Scots law. You and we both irrevocably submit to the exclusive jurisdiction of the Scottish courts in respect of this Licence and any disputes or claims under it or in respect of it.
The terms of the End User Licence Agreement are incorporated into, and form part, of these Terms of Service.
